The NYC Sidewalk Violation Guide (2026)

Every year, the NYC Department of Transportation issues thousands of sidewalk violations to property owners. If one just landed in your mailbox, here's everything you need to know — written by contractors who clear these violations every week.

What Is a Sidewalk Violation?

A sidewalk violation (officially a "Notice of Sidewalk Violation") is DOT's formal finding that the sidewalk fronting your property is defective. Under NYC Administrative Code §19-152, the property owner — not the city — is responsible for maintaining the sidewalk. The violation isn't a fine by itself, but it attaches to your property record and stays there until the sidewalk is repaired and passes re-inspection.

The Defects DOT Cites Most

  • Trip hazards — adjoining flags uneven by 1/2 inch or more (the most common citation)

  • Broken or cracked flags — structural cracks, holes, crumbling concrete

The 75-Day Deadline

From the date on the notice, you have 75 days to repair the sidewalk yourself using a licensed contractor. After that, the city has the right to send its own contractor, do the work on its schedule, and bill you — typically at higher rates, with administrative fees added. If the bill goes unpaid, it can become a lien on the property.

What Ignoring It Really Costs

  • At sale or refinance: the violation shows up in every title search and must be cleared before closing — usually under time pressure, at rush prices.
  • City-performed repair: you lose control of cost, schedule and quality.
  • Liability: if a pedestrian trips on your cited sidewalk, the open violation is powerful evidence of negligence in a lawsuit.

What If a City Tree Caused the Damage?

Owners of one- to three-family homes may qualify for the NYC Parks Trees & Sidewalks Program, which repairs tree-damaged sidewalks free. The catch: the waitlist runs years, and your violation stays active the whole time.
